Memories By Mia - Terms & Conditions

The following Terms and Conditions outline the terms of my services and the expectations I have for a successful collaboration between us. Please read these terms carefully and ensure that you understand them prior booking with Memories by Mia. By booking with Memories by Mia, you agree to all the terms and conditions outlined below. 

Services

Photography services will be provided and billed based on the discussions prior to the photoshoot or event.


Quotes can be provided for all services and are valid for 30 days.


Breaks: I offer regular mini breaks during the shoots for children and pets. For shoots exceeding 3 hours, I require a minimum of 30 minutes for a break. 

Deliverables:

The photos are delivered as digital files through a downloadable secure link, unless otherwise agreed upon.


Turnaround times:

For custom packages, I will have an album for selection to the customer within 14 days from date of the custom photoshoot. 

 

Full albums are provided within 4 weeks of payment. With the exception being weddings, full albums will be provided within 6 weeks of payment.

 

All images are kept available for clients to download for 6 months. 30 days prior to the end of this, a written communication will go out.

 

In the event of receiving a watermarked album for selection or sneak peek, this access will also be revoked after 30 days, if no communication and/or payment is made.

 

A $25 fee may apply if an album, whether for selection or download, needs to be reopened after the above time periods.

Payments:

Booking Fees: A non-refundable booking fee of $50 is required to secure a custom photoshoot with Memories by Mia.


Deposits: For events, a non-refundable deposit of $50 is required upfront and this will be deducted from the final invoice.


Upon receipt of the booking fee or deposit, I will reserve the date and time specified by you.


Album Payments: Images will only be sent upon full payment of the invoice.


Travel: If you choose to not purchase images, or no payment is made within 7 days of issuing the invoice, any applicable travel fees will be charged to the card on file 7 days after the event.  


Event Photography Prepayment:

You are required to pay 50% of the planned event coverage 7 days prior to the event.


Reminders:

For all custom and mini shoots, a reminder SMS will be sent 24 hours prior to the shoot. 


For all events, a reminder SMS will be sent 7 days prior to the event.


Confirmations:

For all custom and mini shoots, a reminder SMS will be sent 24 hours prior to the shoot. 


For all events, a reminder SMS will be sent 7 days prior to the event. 


The start time for any event must be confirmed 7 days prior, or I, as the photographer, have a right to cancel the booking. This cancellation will then attract the below cancellation fees.

Reschedule or Cancellation:

Reschedule: You can reschedule up to 24 hours before your session, provided it is within the Brisbane region, with no reschedule fees. Your deposit will be kept in credit. If you attempt to reschedule within 24 hours of scheduled shoot it is at my discretion whether deposit will be kept in credit for 3 months, or utilized as a reschedule fee. 


Cancellations or No Shows: If you cancel or do not show for the session, the deposit is non-refundable. 


Any cancellations must be submitted in writing. I always do my best to ensure that each message is acknowledged. If you do not receive a response, please text or call 0400 523 833. This ensures that there are no breakdowns in communications.


Cancellation Fees: The below cancellation fees will be charged, to the card provided at the time of booking, on the day of cancellation and/or no show:


Cancellation Fees (Custom Photoshoots)

  • Less than 24 hours: $50
  • No Show Fee: $50


Cancellation Fees (Events Under 3 Hours)

  • Full Cancellation Fee: $150, as below:
  • + 14 Days Notice: No Charge
  • 7-14 Days Notice: 50% of Cancellation Fee
  • Less than 7 Days Notice: 100% of Cancellation Fee


Cancellation Fees (Events Between 3-5 Hours)

  • Full Cancellation Fee: $200, as below:
  • + 14 Days Notice: No Charge
  • 7-14 Days Notice: 50% of Cancellation Fee
  • Less than 7 Days Notice: 100% of Cancellation Fee


Cancellation Fees (Events Between 5-7 Hours)

  • Full Cancellation Fee: $300, as below:
  • + 14 Days Notice: No Charge
  • 7-14 Days Notice: 50% of Cancellation Fee
  • Less than 7 Days Notice: 100% of Cancellation Fee



Rescheduling/Cancellations by Photographer: In unforeseen circumstances such as illness, I reserve the right to cancel the shoot. In such cases, I will reschedule the shoot for another agreed upon time.

Photographic Materials and Copyright:

Ownership: All photographic materials, including original images, final photos, or digital files, shall remain the exclusive property of Memories By Mia. I retain the copyright for all images created and may use them for promotional purposes, including on websites, on social media, samples, contests, exhibitions, and advertising, unless otherwise agreed upon between us.

Liability:

I will not be held liable for any accidents, injuries, or damage to property that may occur during the photography session. It is your responsibility to take care of any children; I will not accept any responsibility for actions of said children.


I shall not be held liable for any misuse or misharing of gallery link. It is the client's responsibility to ensure correct distribution. In the event that a misuse or inappropriate sharing of the link has been made - Memories by Mia can restrict the link to an email addresses only. However, any images already downloaded cannot be erased. 

Confidentiality:

All information and discussions between myself and you as the client are considered confidential and will not be disclosed to any third party.

Responsibility:

It is your responsibility to obtain permission for entry of selected location, including entry of myself as your photographer, and to advise Memories by Mia of any restrictions or policies in place at all applicable locations.


I shall not be held responsible for any photographs requested but not provided resulting from late arrivals, children, wedding parties or any delays due to unforeseen circumstances. 


In the event that the family/guests are taking photos, I am not responsible for obstructed photos or photos ruined due to separate flashes going off or due to any other behaviour from guests. I am not responsible for obstructed or ruined photos due to activities by other vendors and venue staff.

Communication:

All communication between us shall be in English and in written form, typically through email.

Agreement:

By booking my  services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. This Agreement represents the entire understanding between you, the Client, and myself, the Photographer.

Direct Debit Request Service Agreement

  1. By agreeing to the Direct Debit Request you authorise Stripe to arrange for funds to be debited from your nominated financial institution account (the “nominated account”). Stripe is acting as an agent for the Merchant and Stripe does not provide any goods or services to you.
  2. Stripe or the Merchant will give you at least 14 days notice in writing of any changes to the terms of the drawing arrangements.
  3. Stripe will keep information relating to your nominated account confidential in accordance with Stripe’s privacy policy, except where required for the purposes of conducting direct debits with your financial institution. Your personal information will be transferred by Stripe to the United States. If you do not want to provide your personal information to Stripe in connection with the Direct Debit Request, Stripe will not be able to debit your nominated account.
  4. Where the due date is not a business day Stripe will draw from your nominated financial institution account on the next business day.
  5. It is your responsibility to:
  6. Ensure your nominated account can accept direct debits;
  7. Ensure that there are sufficient clear funds available in the nominated account to meet each drawing on the due date;
  8. Advise immediately if the nominated account is transferred or closed or your account details change;
  9. Arrange a suitable payment method if Stripe or the Merchant cancels the drawing arrangements;
  10. Ensure that all authorised signatories nominated on the financial institution account to be debited authorise the Direct Debit Request.
  11. Subject to the terms and conditions of your nominated financial institution account and your agreement with the Merchant, you may alter the drawing arrangements. Such advice should be received by the Merchant at least 7 business days prior to the drawing date for any of the following:
  12. Changing your nominated account number
  13. Deferring a drawing
  14. Altering a DDR schedule
  15. Cancelling the drawings completely
  16. If you require further information, please contact the Merchant. Alternatively, you can also contact your financial institution.
  17. If you believe that there has been an error in debiting your account, you should notify the Merchant as soon as possible. The Merchant will notify you in writing of its determination and the amount of any adjustment that will be made to your nominated account (if any). Stripe will arrange for your financial institution to adjust your nominated account by the applicable amount (if any). Alternatively, you can also contact your financial institution.
  18. The details of your drawing arrangements are contained in the above Direct Debit Request.
  19. Stripe reserves the right to cancel the drawing arrangements if three consecutive drawings are dishonoured by your financial institution, and for the Merchant to arrange with you an alternative payment method. Please refer to the terms and conditions of your nominated financial institution account to see whether dishonour fees apply. The Merchant may charge additional dishonour fees in accordance with your agreement with the Merchant.
